Terms & Conditions

By registering for or using Modelsign ("Service", "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users — photographers ("Photographers") and models or other signatories ("Models").

Modelsign is a digital contract management platform that allows Photographers to:

• Create photography contracts from pre-built templates (model release, TFP, adult content, stock photography, all-in-one explicit).
• Send unique signing links to Models via email or direct link.
• Collect digital signatures, model identity information, and government-issued ID photos from Models.
• Store and manage signed contracts within their account.

To use the full Service, you must create an account. You agree to:

• Provide accurate and truthful registration information.
• Keep your login credentials confidential and not share them.
• Notify us immediately of any unauthorised account access.
• Be at least 18 years of age to register an account.

You are responsible for all activity that occurs under your account.

Modelsign provides pre-written contract templates as a convenience tool. These templates are not legal advice. We make no warranty that any template is legally sufficient, enforceable, or appropriate for your specific jurisdiction or use case.

Photographers are solely responsible for:

• Reviewing and customising contract content before sending.
• Ensuring contracts comply with applicable local, national, and international law.
• Obtaining independent legal counsel where required.
• The legality and ethics of the content being photographed or produced.

When a Model accesses a signing link, they may be asked to:

• Provide their full name and email address.
• Draw a digital signature.
• Upload photos of a government-issued ID for age verification.

By submitting their signature, Models confirm they have read, understood, and freely consented to the contract terms, and that they are at least 18 years of age. The IP address and timestamp of each submission are recorded.

Modelsign is not a party to any contract between a Photographer and a Model. We provide the infrastructure only.

Modelsign includes templates designed for adult content photography, including explicit material. Users must comply with all applicable laws governing adult content in their jurisdiction, including (where applicable):

• 18 U.S.C. § 2257 (United States record-keeping requirements for explicit content).
• EU and UK regulations on obscene or harmful content.
• Age verification and consent legislation in your country.

Use of the adult content templates for illegal content is strictly prohibited and will result in immediate account termination and referral to law enforcement.

You agree not to use Modelsign to:

• Create contracts for or with minors (under 18 years old).
• Coerce, deceive, or defraud any person into signing a contract.
• Forge signatures or falsify identity documents.
• Produce, distribute, or facilitate illegal content of any kind.
• Attempt to gain unauthorised access to other accounts or the platform infrastructure.
• Use the platform in any manner that violates applicable law.

We reserve the right to suspend or terminate any account that violates these terms without prior notice.

You retain ownership of the contract content you create and the data submitted by your Models. By using the Service, you grant Modelsign a limited licence to store, process, and transmit this data solely to operate and provide the Service.

We do not claim ownership of your contracts or your models' personal data.

The Modelsign brand, platform design, templates, and software are owned by Modelsign and protected by applicable intellectual property law. You may not copy, reproduce, reverse engineer, or create derivative works from any part of the platform without prior written consent.

The Service is provided "as is" without warranties of any kind. We do not warrant that:

• The Service will be uninterrupted or error-free.
• Contracts generated via the platform are legally enforceable in any jurisdiction.
• Signatures collected constitute valid legal signatures under all applicable laws.

To the fullest extent permitted by law, Modelsign shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of contracts, loss of revenue, legal disputes between Photographers and Models, or failure of contracts to be enforceable.

Our total liability to you for any claim shall not exceed the amount paid by you to us in the 12 months preceding the claim (or €50 if no payment was made).

You may delete your account at any time. We may suspend or terminate your account if you breach these Terms. Upon termination, your access to contracts stored on the platform will be revoked. See our Privacy Policy for information on data retention after termination.

We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
